Terms of Service

By accessing or using MakeProp (makeprop.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you are using MakeProp on behalf of a business, you represent that you have authority to bind that business.

If you do not agree to these terms, do not use MakeProp.

MakeProp is a real estate marketing platform that helps licensed real estate agents and brokers:

• Enhance and prepare listing photos using AI
• Generate MLS descriptions, listing headlines, and social media captions using AI
• Receive AI-powered Listing Scores with improvement suggestions
• Download complete listing packages for use in real estate marketing

MakeProp is a tool to assist professionals. All AI-generated content must be reviewed, verified, and approved by the agent before use. MakeProp does not practice real estate.

You must be 18 or older to create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You agree to provide accurate information when creating your account and to keep it up to date. MakeProp reserves the right to suspend or terminate accounts that provide false information or violate these terms.

MakeProp is in active pre-launch development. Paid plans and pricing have not been finalized, and no charges are made today. Any plans, prices, and billing terms will be published before they take effect, and you will never be charged without first agreeing to them.

When paid plans become available, the specific terms — price, billing period, cancellation, and any refund policy — will be presented at the point of purchase and will govern that transaction.

You retain ownership of all photos, listing details, and other content you upload to MakeProp (“Your Content”). By uploading content, you grant MakeProp a limited, non-exclusive license to process and store it solely for the purpose of providing the service to you.

You are responsible for ensuring you have the right to upload any content. Do not upload photos that you do not have rights to, photos of people without consent, or content that violates any law.

MakeProp uses Anthropic’s Claude AI to generate MLS descriptions, headlines, social captions, hashtags, and Listing Scores. You acknowledge that:

• AI-generated copy may contain inaccuracies and must be reviewed before use
• You are solely responsible for verifying that all MLS submissions are accurate and compliant with your MLS rules and regulations
• MakeProp does not guarantee the accuracy, completeness, or fitness for purpose of any generated content
• AI-generated content does not constitute legal, financial, or professional real estate advice

MakeProp’s photo enhancement and virtual staging features modify the appearance of listing photos. You agree to use these features responsibly and in compliance with your MLS rules and applicable law:

• Virtually staged photos must be clearly labeled as “virtually staged” when published on MLS or other listing portals
• MakeProp does not alter the structural elements of a property — it only adds or adjusts furniture and lighting
• You must not use enhanced photos in a way that materially misrepresents the property
• Original (unmodified) photos are always retained in your account for disclosure purposes

You agree not to:

• Use MakeProp to generate false or misleading property representations
• Upload photos of properties you do not have the right to market
• Use MakeProp for any unlawful purpose or in violation of any regulation
• Attempt to reverse-engineer, scrape, or abuse MakeProp’s AI capabilities
• Share your account credentials with unauthorized users
• Use MakeProp to send spam or unsolicited communications

MakeProp’s software, design, and underlying technology are the intellectual property of MakeProp. Nothing in these terms grants you any rights to MakeProp’s trademarks, software, or brand.

AI-generated copy (MLS descriptions, captions, headlines, hashtags) produced for your listings is yours to use as you see fit, subject to the limitations in the AI-Generated Content section above.

MakeProp is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that MakeProp will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose.

To the maximum extent permitted by law, MakeProp’s total liability for any claim arising from use of the service is limited to the amount you paid to MakeProp in the three months preceding the claim. MakeProp is not liable for indirect, incidental, special, consequential, or punitive damages.

We may update these terms from time to time. Material changes will be communicated by email. Continued use of MakeProp after changes constitutes acceptance of the revised terms.

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
